1. Introduction

These Terms & Conditions (“Terms”) govern your use of the AIssistant mobile application (“App”) provided by AIssistant (“us”, “we”, or “our”). By accessing and using the App, you agree to be bound by these Terms. If you disagree with any part of the Terms, please do not use the App.

2. Acceptance of Terms

By creating an account or using our App, you confirm that you have read, understood, and agreed to these Terms and any other applicable policies, including our Privacy Policy.

3. Description of the App and Services

AIssistant is a mobile application that provides users with access to an AI-powered chat assistant, offering personalized assistance, information, and support across various topics and integrated services.

Friendly AI

  • The Friendly AI feature of AIssistant is designed for entertainment and educational purposes only. It is not intended to provide medical, legal, or financial advice. Users of the Friendly AI feature should not rely on it for important decisions or in situations where accuracy is critical.

Trip Planner

  • The Trip Planner feature of AIssistant provides travel information and recommendations based on user preferences and data. AIssistant is not responsible for any errors, omissions, or inaccuracies in the information provided by the Trip Planner feature. Users should verify any travel information or recommendations with official sources or travel providers.

Grammar Checker

  • The Grammar Checker feature of AIssistant is intended to improve writing and communication skills. It is not intended to provide legal or professional advice. Users should not rely on the Grammar Checker feature for critical or sensitive documents.

AIssistant

  • AIssistant is an AI-powered app designed to simplify everyday tasks and enhance productivity. It is provided for informational and educational purposes only. AIssistant is not responsible for any harm or injury that may result from the use of the app or the information provided by its features.

Sentiment Analysis

  • The Sentiment Analysis feature of AIssistant is intended to help users understand the emotions behind text. It is not intended to provide medical, legal, or financial advice. Users of the Sentiment Analysis feature should not rely on it for important decisions or in situations where accuracy is critical.

Image Generator

  • The Image Generator feature of AIssistant is intended to assist users in generating visual content. Users should be aware that the images generated by the feature may be subject to copyright or other intellectual property laws. AIssistant is not responsible for any infringement of intellectual property rights resulting from the use of the Image Generator feature.

Grammar Checker

  • The Grammar Checker feature of AIssistant is intended to improve writing and communication skills. It is not intended to provide legal or professional advice. Users should not rely on the Grammar Checker feature for critical or sensitive documents.

Recipe Creator & Fitness Assistant

  • The recipe finder and fitness assistant features of AIssistant are provided for informational and educational purposes only. The information provided by these features is not intended to be a substitute for professional medical advice, diagnosis, or treatment.
  • Users of the recipe finder and fitness assistant should be aware that the information provided by these features is general in nature and may not be appropriate or suitable for everyone. It is the responsibility of the user to consult with their healthcare provider before using the recipe finder and fitness assistant or starting any new diet or exercise program.
  • By using the recipe finder and fitness assistant features, the user acknowledges and accepts that AIssistant is not responsible for any harm or injury that may result from the use of the information provided by these features.
  • The user is solely responsible for any actions taken based on the information provided by the recipe finder and fitness assistant features, and assumes all risks and liabilities associated with such actions.
  • AIssistant is not responsible for any errors, omissions, or inaccuracies in the information provided by the recipe finder and fitness assistant features. The user agrees to use these features at their own risk and to indemnify and hold AIssistant harmless from any claims or damages arising from their use of these features.
  • By using the recipe finder and fitness assistant features, the user agrees to abide by these terms and conditions, as well as any other terms and conditions or policies set forth by AIssistant.
  • AIssistant reserves the right to modify or discontinue the recipe finder and fitness assistant features at any time without prior notice.

4. User Accounts and Registration

To access certain features of the App, users may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary. You are responsible for safeguarding your account password and for any activities that occur under your account.

5. Age Restrictions

AIssistantapp is committed to protecting the safety and privacy of young users. The AIssistant mobile application (“App”) is intended for users aged 16 and older. By using the App, you affirm that you are at least 16 years of age.

  • Age Verification: To help ensure compliance with age restrictions, we may implement age verification measures, such as requiring users to provide their date of birth during registration or sign-up. If we discover that a user is under the age of 16, we reserve the right to terminate their account and delete any personal information associated with their account.
  • Parental Controls: Parents and guardians are encouraged to discuss and monitor their children’s online activities and use of apps. If you believe that your child under the age of 16 has provided us with personal information or has created an account on the App without your consent, please contact us at [email protected]. We will take appropriate action to remove any personal information and delete the account.
  • Compliance with Children’s Privacy Laws: As our App is not directed at children under the age of 16, we do not knowingly collect personal information from children under 16. We are committed to complying with all applicable laws and regulations, including the Children’s Online Privacy Protection Act (COPPA) and other similar regulations in different jurisdictions. If we become aware that we have collected personal information from a child under the age of 16, we will take appropriate steps to delete that information.
  • Changes to this Age Restrictions Section: We may update this Age Restrictions section from time to time to reflect changes in our practices, the App’s features, or applicable laws and regulations. We will notify you of any material changes to this section by posting a notice within the App or by sending you an email. Your continued use of the App after any changes to the Age Restrictions section constitutes your acceptance of the updated Age Restrictions.

6. User Conduct and Acceptable Use

You agree not to use the App for any unlawful or prohibited purposes and to comply with all applicable laws and regulations. You are responsible for your actions and any content you submit through the App. You agree not to engage in behavior that is harmful, harassing, defamatory, or otherwise objectionable.

7. Intellectual Property Rights

All intellectual property rights in the App, including but not limited to copyrights, trademarks, and patents, are owned by AIssistantapp or its licensors. You may not copy, reproduce, distribute, or create derivative works from the App without express written permission from AIssistantapp or its licensors.

8. Third-Party Links and Services

AIssistant uses the ChatGPT API, which is powered by OpenAI, to provide its features. The ChatGPT API is a machine learning tool that uses artificial intelligence to generate human-like responses to user input.

By using AIssistant, the user acknowledges and accepts that the app is using the ChatGPT API to provide its services. The user further acknowledges and accepts that the ChatGPT API is a third-party service provided by OpenAI and is subject to OpenAI’s terms of service and privacy policy.

AIssistant is not responsible for any errors, omissions, or inaccuracies in the responses generated by the ChatGPT API. The user should not rely on the responses generated by the ChatGPT API for critical or sensitive information.

AIssistant takes user privacy and data protection seriously. The user’s data is encrypted and securely transmitted to the ChatGPT API for processing. The user’s data is never shared with third parties without the user’s express consent, except as required by law.

By using AIssistant, the user agrees to abide by these terms and conditions, as well as any other terms and conditions or policies set forth by AIssistant or OpenAI.

9. Subscription and Payment Terms

If the App offers subscription services, users will be billed in advance on a recurring basis, as specified during the registration process. Payment for subscriptions will be processed through the default payment gateway provided by the Google Play Store Console or iOS App Store, as applicable.

Users may cancel their subscription at any time by following the cancellation instructions provided by the Google Play Store Console or iOS App Store, as applicable. Refunds are subject to the Google Play Store Console or iOS App Store refund policies, as applicable.

We reserve the right to change our subscription fees at any time with prior notice, as permitted by the Google Play Store Console or iOS App Store terms and conditions. Any changes to subscription fees will be communicated to users through the Google Play Store Console or iOS App Store, as applicable.

By using the App and subscribing to its services, users agree to abide by the terms and conditions set forth by the Google Play Store Console or iOS App Store, as applicable, with respect to subscriptions and payments.

10. Limitation of Liability

In no event shall AIaaisatant or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data, or goodwill, arising out of or in connection with your use of the App, even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold harmless Skill Connect LTD, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees, arising out of or in connection with your access to or use of the App or your violation of these Terms.

12. Termination

We reserve the right to terminate or suspend your access to the App at any time, with or without cause or notice, for any reason or no reason, including if we believe that you have violated these Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within New Zealand to resolve any disputes arising out of or relating to these Terms or your use of the App.

14. Changes to the Terms

We reserve the right to modify or replace these Terms at any time, at our sole discretion. We will notify you of any changes by posting the updated Terms on the App. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
